Because our core services (adaptive gaming evaluations and equipment) are provided in-person, we limit the personal information we collect through our website. The information we collect online falls into the following categories:

   -To send our email newsletter and communicate about events, services, or donations.

   -Gamer's Name (for adult gamers), Parent/Guardian Name, Disability information (optional), Gaming preferences, Age (to      confirm adult/parent status), and Contact Information.

   -To facilitate your participation in in-person events and programs, including necessary accommodations.

-Technical & Usage Data

   -IP address, browser type, device information, and pages visited on our site.

   -To monitor website traffic, diagnose technical issues, and improve website functionality. Note: This is primarily collected         by our hosting provider, Wix.com, and is used for internal operations only.

 

2. How We Use Your Information

• To Provide Our Mission: To register you or your minor child for in-person evaluations, equipment loans, and events.

• Communication: To send you our newsletter, updates about our programs, and respond to your inquiries.

• Internal Operations: To maintain and improve our website and internal records, and to fulfill any legal or regulatory obligations.

A. Partner Organizations

As part of our commitment to serving the adaptive gaming community, we partner with other non-profit organizations. By signing up for our services or events, you acknowledge and consent to us sharing relevant gamer information (e.g., name, disability information, and contact details) with the following organizations for the sole purpose of facilitating or enhancing adaptive gaming services, equipment, or outreach:

B. Service Providers

We use third-party service providers to help us operate our website and manage our activities. These providers are obligated to protect your information and may only use it for the specific purposes we define.

• Wix.com: Our website is hosted on the Wix.com platform. All data collected on our website (including form submissions for newsletters and events) is stored on Wix’s secure servers. 4. Children’s Privacy and COPPA Compliance

Our Website is NOT Directed at Children Under 13.

The Children’s Online Privacy Protection Act (COPPA) places requirements on websites that collect personal information from children under 13.

As a non-profit organization, we are generally exempt from COPPA, but we take the protection of minors’ data seriously.

• Policy on Minors: Our event registration and newsletter sign-up are designed for, and directed toward, adult gamers (age 18+) or parents/legal guardians of minor gamers.

• Collection Intent: We do not knowingly collect any Personal Information directly from children under the age of 13 through our website.

• Verifiable Consent: If an individual is under the age of 18, we require a parent or legal guardian to complete the online event registration form, thereby providing verifiable consent for the collection of the minor's name and any other necessary information needed for our in-person, non-commercial services.

• If We Learn of Unintended Collection: If we become aware that we have inadvertently received personal information from a child under the age of 13 without verifiable parental consent, we will delete that information from our records immediately. If you believe a child under 13 has provided us with their personal information, please contact us immediately using the information in Section 6.

 

5. California Privacy Rights (CCPA/CPRA)

The California Consumer Privacy Act of 2018 (CCPA), as amended by the California Privacy Rights Act (CPRA), grants certain rights to California residents regarding their personal information.

Note on Non-Profit Status: RX Gaming is a non-profit organization. Non-profit entities are generally exempt from the full scope of the CCPA/CPRA unless they are controlled by, or share common branding with, a covered for-profit business. We are not affiliated with a covered for-profit business.

However, we are committed to upholding the spirit of transparency and consumer rights, and we extend the following rights to all users of our site:

You have the right to request that we disclose the categories of personal information we have collected, used, disclosed, and shared about you over the past 12 months.

You have the right to request the deletion of your personal information that we have collected, subject to certain exceptions (such as retaining information needed for legal obligations or to complete a transaction).

• We Do Not Sell Personal Information: RX Gaming does not sell your personal information in exchange for monetary compensation.

• Data Sharing: We share data with our non-profit partners (Section 3.A) to fulfill our mission, but this is not considered a "sale" or "sharing" under CCPA as it is a core part of the non-profit services we provide, and is not done for cross-context behavioral advertising. You can opt-out of this sharing by submitting a deletion request (Right to Delete).
